Advocacy/Due Process

| Before positions harden and tempers begin to flare, it often is possible to resolve and neutralize many of the issues which historically trigger due process hearings. I am a firm believer in the benefits of "early intervention" in the educational plan process. Accordingly, to the extent feasible, I like to become involved proactively at the earliest stages before there is an actual confrontation or full-blown dispute. If you have reason to anticipate difficulties with your school district or municipality, I can assist you to make an ample and appropriate documentary record. For example, if you are not satisfied with the evaluation secured by your school district or municipality, you may be entitled to reimbursement for the cost of securing an independent evaluation. It is not unusual to resolve placement, funding and other disputes by way of negotiation or mediation. If, however, you are compelled to proceed to due process, I will personally review your childs educational records, as supplied by you, and interview prospective witnesses in order to identify the salient issues and themes for the hearing. I also will assist you to retain an expert witness, should there be the need for one. There may be any number of reasons why you might want or need to use your "regular" attorney or one who would be considered "local" to the site of the hearing. If you would prefer to use another attorney to prosecute the due process hearing, I often can be retained as a consultant to help your attorney develop themes and strategy, become familiar with the pertinent statutes and controlling decisional law, frame questions, prepare witnesses, introduce evidence, and/or submit legal memoranda. Simply stated, I am prepared to proceed in the manner which will best promote the interests and welfare of your child. |
